Bernie Madoff’s crimes tend to be blamed on insufficient legislation: had the relevant regulatory agencies been doing their work, it is thought, the Madoff-debacle would never have occurred. But I suspect that Madoff’s crimes may themselves have already been a consequence of a superabundance of regulations, the effect which was to create it prohibitively challenging to make profit the monetary sector without breaking the law.
